Terrance Fountaine et al. v. Advanced Family Practice Inc. et al.

After only four hours of deliberation, a Montgomery County Ohio jury awarded Brannon Law Firm client Terrance H. Fountaine and his family $6,067,830 for the wrongful death of his wife, Karla Fountaine. Dwight Brannon filed the medical malpractice and wrongful death suit against Good Samaritan Hospital, Premier Health Partners, and Dr. Cheryl Gill who negligently failed to diagnose severe pre-eclampsia, eclampsia and ultimately a stroke that developed during her course of pregnancy.  The failure of the physicians to diagnose and treat these medical conditions ultimately resulted in her death. This tragic situation could have been avoided had the hospital and physicians followed basic safety rules for patient care relating to pregnant women. When hospitals and physicians ignore the safety rules for patient care and place profits over people, they endanger members of the Dayton community. At the Brannon Law Firm it is important to our attorneys that the standard of medical care in our community is not compromised by hospitals and physicians who fail to take the time to talk with, examine and properly treat patients. There is simply no reason, given advanced modern medicine and treatment facilities, that a pregnant woman like Karla Fountaine should die when experiencing minor complications during pregnancy. This is one of the largest verdicts ever awarded in a medical malpractice case in the Montgomery County Ohio Courts and reflects the great loss suffered by the Fountaine family.
